Voucher Compensation Policy and Passenger Rights
 Protection under EU Regulation (EC) No. 261/2004
Our company, as a licensed and compliant booking intermediary, is fully committed to safeguarding passengers’ rights and ensuring fair, lawful compensation in the event of flight cancellations by the airline for any reason. This policy is based on EU Regulation (EC) No. 261/2004 and relevant Court of Justice of the European Union (CJEU) rulings, and is applied as follows:
1. Flexible Booking — An Integral Commitment
Upon completing a booking through our platform and paying its full price, the passenger automatically benefits from our flexible booking policy, which guarantees:
  • The right to modify the travel date or destination within the same airline.
  • All modifications are subject to the carrier’s internal policies and applicable fare rules (Articles 3 and 5 of the Regulation).
  • The company is not liable for securing approval for changes if seat availability is limited or if fare conditions prevent changes.
  • The passenger is obliged to pay any fare difference resulting from the new date or destination.
  • If no alternative seats are available or the airline refuses the requested change, the original ticket remains valid under its initial conditions, and the company has no obligation to cancel the booking or provide any refund.
The amount paid for the booking covers a unified package of services, including:
  • A flexible ticket within the carrier’s policy.
  • Support for modifications and technical or administrative follow-up.
  • Assistance with check-in procedures and monitoring flight status.
  • Legal support to claim compensations where applicable.

2. Legal Commitment to Claim Compensation if the Flight is Cancelled by the Airline
Under Article 5(1)(c) of Regulation (EC) No. 261/2004, passengers are entitled to statutory compensation ranging from EUR 250 to EUR 600, depending on the flight distance (Article 7(1)). Our company guarantees to:
  • File a formal claim on behalf of the passenger with the operating airline.
  • Conduct all administrative and legal procedures to secure the full amount.
  • Escalate the case to the competent court if necessary, in line with CJEU precedents such as C-83/10 Finnair and C-76/23 Cobult.

In accordance with Articles 7(3) and 8(1) of the Regulation and aligned with EU court precedents, our company provides a voucher compensation as an alternative that lawfully satisfies the passenger’s entitlement when a flight is cancelled by the carrier. The voucher is structured as follows:
  • Voucher Value: Equal to 100% of the total amount paid for the original booking, with no deductions or fees.
  • Validity: Valid for twelve (12) months from the original cancelled flight date.
  • Permitted Use: The passenger may redeem the voucher for:
    • A new flight to any destination.
    • Any travel date within the validity period.
    • Use for the same or different passenger names.
    • Booking other eligible services provided by our company, such as hotel reservations, visa issuance, or comprehensive tour packages.
  • Partial Use: The voucher can be used in full or partially, and the remaining balance remains valid until fully redeemed within the validity period.
  • Balance Protection: The company guarantees that the full value is retained with no administrative fees deducted when used.

Article 7(3) — The carrier may offer an alternative form of compensation.Article 8(1) — Right to re-routing and alternative services.
4. The Legal Basis for the Voucher as an Equivalent
The voucher is not merely an optional benefit but a legally recognized equivalent to monetary compensation under the EU regulatory framework, as reinforced by CJEU rulings such as C-76/23 Cobult, confirming that providing a service of equivalent value fulfills the carrier’s compensation obligation.
5. No Right to a Monetary Refund
The issuance of a voucher constitutes a full settlement covering the passenger’s financial rights related to the cancelled booking, consistent with Articles 5, 7, 8, and 9 of Regulation (EC) No. 261/2004 and relevant EU case law. Therefore, once the voucher is issued, the passenger is not entitled to claim a monetary refund for any portion of the services included.

Article 3: Conclusion of the Agreement

Article 5: Modification of the Agreement
5.1 The agreement may only be amended if all parties involved agree in writing to the changes.5.2 Any additional costs arising from amendments made after the conclusion of the agreement shall be borne by the parties involved.
Article 6: Suspension or Termination of the Agreement
6.1 VIP LUXURY TOUR reserves the right to suspend or terminate the agreement if the client fails to fulfill the agreed obligations or if circumstances render performance impossible.6.2 Early termination due to non-compliance by the client does not entitle the client to any compensation from VIP LUXURY TOUR.6.3 In the event of early termination, VIP LUXURY TOUR shall not be liable for any resulting damages or losses.
Article 7: Cancellation
7.1 Services may be canceled without additional charges if canceled on the same day, in accordance with supplier policies.7.2 All online bookings are subject to the terms and conditions of the respective suppliers, and cancellation policies may vary by supplier.
Article 8: Costs, Fees, and Payments
8.1 All prices are in Euros and include VAT unless explicitly stated otherwise.8.2 Payments are to be made via iDeal or in cash. VIP LUXURY TOUR does not charge additional shipping fees within the Netherlands and Belgium.8.3 All invoices must be paid before the trip commences. In case of non-payment, VIP LUXURY TOUR reserves the right to suspend or cancel the services.
Article 9: Liability
9.1 VIP LUXURY TOUR is not liable for any incorrect or misleading information provided by the client or errors committed by third parties.9.2 VIP LUXURY TOUR’s liability is limited to direct damages resulting from failure to perform the agreement, and is capped at the amount covered by the applicable insurance related to the services provided.
Article 10: Force Majeure
10.1 Force majeure includes any circumstances beyond the parties’ control that prevent timely performance of the agreement, including natural disasters, wars, or economic crises.10.2 If a force majeure situation persists for more than one month, either party may terminate the agreement without compensation, and any payments made by the client shall be refunded after deducting incurred costs.
Article 11: Data Confidentiality
11.1 VIP LUXURY TOUR is committed to maintaining the confidentiality of all data and information received from the client.11.2 VIP LUXURY TOUR complies with the General Data Protection Regulation (GDPR) and collects personal data solely on a lawful basis.11.3 Personal data shall not be shared with third parties without the client’s consent unless required by law.
Article 12: Complaints Procedure
12.1 All complaints related to services provided must be submitted to VIP LUXURY TOUR via email at INFO@LUXURYTOUR.NL.12.2 Complaints will be processed within 30 days of receipt, and the client will be informed of the measures taken.

1. الحجز المرن — التزام أساسي
عند إتمام الحجز عبر شركتنا ودفع قيمته بالكامل، يستفيد المسافر تلقائيًا من سياسة الحجز المرن، والتي تضمن له ما يلي:
  • الحق في تعديل تاريخ الرحلة أو الوجهة ضمن نفس شركة الطيران.
  • تخضع جميع التعديلات للسياسات الداخلية للناقل الجوي وقواعد الأسعار السارية (المادتان 3 و5 من اللائحة).

  • إذا لم تتوفر مقاعد بديلة أو رفضت شركة الطيران التعديل المطلوب، تبقى التذكرة الأصلية سارية بشروطها الأصلية، ولا تتحمل الشركة أي التزام بإلغاء الحجز أو إعادة المبلغ.
يشمل المبلغ المدفوع مقابل الحجز باقة متكاملة من الخدمات، من ضمنها:
  • تذكرة مرنة ضمن سياسة الناقل.
  • دعم فني وإداري لأي تعديل مطلوب.
  • المساعدة في إجراءات إنهاء السفر (التشيك إن) ومتابعة حالة الرحلة.
  • دعم قانوني للمطالبة بالتعويضات عند الاقتضاء.

2. الالتزام القانوني بالمطالبة بالتعويض في حال إلغاء الرحلة من قبل الناقل
بموجب المادة 5(1)(ج) من اللائحة (EC) رقم 261/2004، يحق للمسافرين الحصول على تعويض قانوني يتراوح من 250 إلى 600 يورو بحسب مسافة الرحلة (المادة 7(1)). وتضمن شركتنا ما يلي:

  • قيمة القسيمة: تعادل 100% من المبلغ الإجمالي المدفوع للحجز الأصلي، دون أي خصم أو رسوم.
  • مدة الصلاحية: صالحة لمدة اثني عشر (12) شهرًا من تاريخ الرحلة الملغاة.
  • كيفية الاستخدام: يمكن للمسافر استخدام القسيمة لـ:
    • حجز رحلة جديدة لأي وجهة.
    • اختيار أي تاريخ سفر ضمن فترة الصلاحية.
    • استخدامها لنفس المسافرين أو لأسماء جديدة.
    • استخدامها لأي خدمة أخرى متاحة من قبل شركتنا، مثل حجوزات الفنادق أو التأشيرات أو البرامج السياحية الشاملة.
  • الاستخدام الجزئي: يمكن استخدام القسيمة كاملة أو جزئيًا، مع بقاء الرصيد صالحًا حتى يتم استهلاكه بالكامل ضمن فترة الصلاحية.
  • ضمان الرصيد: تضمن الشركة بقاء القيمة كاملة دون خصم أي رسوم إدارية عند الاستخدام.

4. الأساس القانوني للقسيمة كبديل مكافئ
لا تُعد القسيمة مجرد ميزة إضافية، بل هي بديل قانوني معترف به للتعويض النقدي بموجب الإطار التنظيمي الأوروبي، كما أيدته محكمة العدل الأوروبية في أحكام مثل C-76/23 Cobult، التي أكدت أن تقديم خدمة ذات قيمة مكافئة يفي بالتزام شركة الطيران بالتعويض.
5. عدم الحق في استرداد نقدي
إصدار القسيمة يُعتبر تسوية كاملة ونهائية تغطي جميع الحقوق المالية للمسافر المتعلقة بالحجز الملغى، وذلك وفقًا للمواد 5 و7 و8 و9 من اللائحة (EC) رقم 261/2004 والأحكام القضائية ذات الصلة. لذلك، بمجرد إصدار القسيمة، لا يحق للمسافر المطالبة باسترداد نقدي لأي جزء من الخدمات المشمولة.

المادة 5: تعديل الاتفاقية
5.1 لا يجوز تعديل الاتفاقية إلا إذا اتفقت جميع الأطراف المعنية على التعديلات كتابيًا.5.2 يتحمل الأطراف المعنية التكاليف الإضافية الناتجة عن التعديلات التي تتم بعد إبرام الاتفاقية.
المادة 6: تعليق أو إنهاء الاتفاقية
6.1 تحتفظ VIP LUXURY TOUR بالحق في تعليق أو إنهاء الاتفاقية إذا أخلّ العميل بالالتزامات المتفق عليها أو إذا أصبحت الظروف تجعل تنفيذ الاتفاقية مستحيلًا.6.2 لا يحق للعميل المطالبة بأي تعويض من VIP LUXURY TOUR في حال الإنهاء المبكر بسبب عدم الامتثال.6.3 في حال الإنهاء المبكر، لا تتحمل VIP LUXURY TOUR أي مسؤولية عن الأضرار أو الخسائر الناتجة.
المادة 7: الإلغاء
7.1 يمكن إلغاء الخدمات دون رسوم إضافية إذا تم الإلغاء في نفس اليوم، وفقًا لسياسات الموردين.7.2 تخضع جميع الحجوزات عبر الإنترنت لشروط وأحكام الموردين المعنيين، وقد تختلف سياسات الإلغاء من مورد لآخر.
المادة 8: التكاليف والرسوم والدفع

المادة 9: المسؤولية
9.1 لا تتحمل VIP LUXURY TOUR المسؤولية عن أي معلومات غير صحيحة أو مضللة مقدمة من العميل أو عن الأخطاء المرتكبة من قبل أطراف ثالثة.9.2 تقتصر مسؤولية VIP LUXURY TOUR على الأضرار المباشرة الناتجة عن الإخفاق في تنفيذ الاتفاقية، ويتم تحديدها بمبلغ التأمين الذي يغطي المخاطر المتعلقة بالخدمات المقدمة.
المادة 10: القوة القاهرة

المادة 11: سرية البيانات
11.1 تلتزم VIP LUXURY TOUR بالحفاظ على سرية جميع البيانات والمعلومات المستلمة من العميل.11.2 تلتزم VIP LUXURY TOUR بالامتثال للائحة العامة لحماية البيانات (GDPR) ولا تجمع البيانات الشخصية إلا بناءً على أساس قانوني.11.3 لا تتم مشاركة البيانات الشخصية للعميل مع أطراف ثالثة دون موافقة العميل ما لم يقتضِ القانون ذلك.
المادة 12: إجراءات الشكاوى
12.1 يجب تقديم جميع الشكاوى المتعلقة بالخدمات المقدمة إلى VIP LUXURY TOUR عبر البريد الإلكتروني على INFO@LUXURYTOUR.NL.12.2 تتم معالجة الشكاوى خلال 30 يومًا من تاريخ استلامها، وسيتم إبلاغ العميل بالإجراءات المتخذة.
